Insert a hyperlink to a resource

You can insert a hyperlink to any digital documentary resource (journals, books, web page, etc.), whether if it is protected by a copyright or copyright-free, without asking permission or reporting the use to Copibec. If there is an UdeM reserved-access document resource, only students enrolled in an UdeM curriculum and staff, which are covered by the licences, may access them. These latter will also have to set up their Proxy to be able to access off-campus. Uploading a copy of a document in a StudiUM formation continue course

There is no need to ask permission if you do the following:

• Reproduce a public domain work.
• Reproduce, under the conditions defined by the author, a work which is assigned a Creative Commons.  
• Upload for educational purposes a copyright protected document which is available free on the Internet as long as the distribution is restricted to duly registered students in this UdeM activity, the source is mentioned, the reproduction was not made by circumventing a technological protection measure and the is no notice on the site stating that it is forbidden to do so (Article 30.04 of the law).
• Under the Copibec agreement signed by UdeM, reproduce in a course a journal article or a book chapter not covered by the possibilities listed above provided you declare each use through the Web form on the website of the Print services (French only).

What about fair use ?  The Copyright Act does not specify specific tags on what constitutes fair use in an educational context. Therefore, if you wish to invoke this exception to the law in order to reproduce a copyright protected document in your StudiUM formation continue course, you must judge for yourself (as it engages your responsibility) if the intended use is fair using the 5 criteria defined by case law, namely: the purpose; nature and scale of use; the existence or absence of alternatives; the nature of the work used; the effect of the use of the said work; the respect for moral rights.

Beyond these possibilities, you must obtain permission of the author or the holder of copyright, in order to use protected content, to reproduce, to adapt, to translate or to communicate it.
